At the direction of Congress, Recovery Audit Contractors (RAC) were assigned to detect and correct improper payments in the Medicare Fee Service program. During the demonstration phase (2005 - 2008) an estimated $1.03 billion in improper payments were identified. As of January 1, 2010, RAC audits have become a permanent nationwide program.

Recovery Audit Contractors perform both automated and complex claims review and conduct both pre-and post- payment reviews. Increased regulation has required physician practices to spend more time on complicated administrative issues, creating new liability challenges. Physicians are legitimately concerned that a single unintentional violation, one of many regulations, can bankrupt their practice.
